Interview with Steve Bliss, Esq.
Good evening, San Diego. I’m here tonight with Steve Bliss, a prominent probate attorney in our community. Steve, thank you for joining us.
Steve, many of our viewers may not be familiar with the complexities of probate. Could you walk us through one of the key steps involved?
Handling Debts and Taxes
Absolutely. One crucial step in the probate process is handling debts and taxes. This involves identifying all outstanding debts owed by the deceased, such as credit card bills, medical expenses, and utility bills.
Once these debts are identified, they must be prioritized and paid according to legal requirements. Ordinarily, secured debts, like mortgages, take precedence over unsecured debts. Conversely, taxes owed by the estate, both federal and state, also need to be calculated and paid promptly.
It’s important to note that failure to properly address debts and taxes can lead to penalties and delays in the probate process. Consequently, working with an experienced probate attorney is highly advisable during this stage.
A common misconception is that all debts must be settled before assets can be distributed to heirs. Nevertheless, California Probate Code allows for partial distributions to beneficiaries while certain debts are still pending. This ensures a more efficient and timely resolution for everyone involved.
Speaking of efficiency, a recent study by the American Bar Association found that estates with proper debt management during probate were settled an average of 30% faster than those without.
Challenges Faced
Steve, have you encountered any particular challenges related to handling debts and taxes in your practice?
I remember a case where the deceased had accumulated significant credit card debt. The family was overwhelmed and unsure how to proceed. We meticulously reviewed all financial records, negotiated with creditors on their behalf, and ultimately secured favorable settlements that allowed for a fair distribution of assets.
Another instance involved an estate with complex tax liabilities. We worked closely with certified public accountants to ensure accurate calculations and timely filings. This proactive approach saved the beneficiaries thousands of dollars in potential penalties.
