Moreno Valley Probate Attorney Discusses Estate Planning

Interview with Brenda Lee of KVCR News

Today we’re joined by Steve Bliss, a renowned probate attorney serving the Moreno Valley community. Steve, thank you for taking the time to speak with us today.

The Importance of Estate Planning

Steve, why is estate planning so important, and what are some common misconceptions people have about it?

“Estate planning is crucial because it allows individuals to control what happens to their assets after they pass away,” explains Steve. “It minimizes family disputes, ensures your wishes are respected, and can even save on taxes.” He clarifies a common misconception: “People often think estate planning is only for the wealthy, but everyone, regardless of income level, can benefit from it.”

Understanding Trusts

Steve, could you elaborate on the different types of trusts available and how they might be beneficial?

“Trusts are powerful legal tools that can serve various purposes,” Steve explains. “Let’s focus on Revocable Living Trusts. They’re incredibly popular because they provide flexibility and privacy.” He continues, “With a Revocable Living Trust, you retain control over your assets during your lifetime and can make changes as needed.

Consequently, upon your passing, the trust avoids probate – a lengthy and often expensive legal process. This means your assets are distributed to your beneficiaries more quickly and privately.”

“Moreover, Revocable Living Trusts can be tailored to meet specific needs,” Steve adds. “For example, you can include provisions for managing assets for minor children or beneficiaries with special needs. Trust planning is not a one-size-fits-all solution; it’s about crafting a strategy that aligns with your individual circumstances and goals.”

I recall working with a young couple who were concerned about what would happen to their children if something happened to both of them. Through careful estate planning, including a Revocable Living Trust, we were able to designate guardians for their children and ensure their financial well-being was protected. The peace of mind it brought them was immeasurable.

Challenges and Solutions

Are there any potential challenges or pitfalls people should be aware of when setting up a trust?

“Like any legal instrument, trusts require careful drafting and execution,” Steve cautions. “It’s crucial to work with an experienced probate attorney who can guide you through the process and ensure your trust is legally sound.” He emphasizes: “One common mistake people make is failing to properly fund their trust. Assets must be transferred into the trust for it to be effective. Neglecting this step can render the trust useless.”

Notwithstanding these potential challenges, the benefits of trusts often outweigh the risks. According to a study by the American Bar Association, over 60% of Americans lack a will or estate plan. This statistic highlights the urgent need for individuals to take control of their financial future.

Next Steps

Steve, what advice would you give to our viewers who are considering setting up an estate plan?

“Start by scheduling a consultation with a qualified probate attorney,” Steve recommends. “We can assess your individual needs and recommend the best course of action for you. Remember, estate planning is not just about death; it’s about protecting your loved ones and ensuring your legacy lives on.”

“Don’t put it off any longer. Take the first step towards securing your future and that of your family.”
