Absolutely. This stage is crucial because it involves a thorough assessment of the individual in question, often referred to as the ‘proposed ward.’ The court appoints an investigator or guardian ad litem who conducts interviews with the proposed ward, their family members, caregivers, and potentially medical professionals.
“Think of it like a comprehensive fact-finding mission,” Ted explains. “The investigator’s role is to gather information about the individual’s capacity to make decisions regarding their personal care, finances, or both.” He adds, “They also review living conditions and any relevant medical evaluations to paint a complete picture for the court.”

Courts typically require that less restrictive alternatives—such as powers of attorney, supported decision-making arrangements, or advance directives—be thoroughly explored and deemed ineffective or unavailable before appointing a guardian or conservator.
