Steve: Thank you for having me. Estate planning is crucial for everyone, regardless of age or financial status. It allows individuals to control how their assets are distributed after they pass away and ensures their wishes are honored. What Types of Trusts are Available?

Steve: There are various types of trusts available, each serving a specific purpose. Today, I want to focus on the Revocable Living Trust. This is one of the most common estate planning tools because it offers flexibility and control.

A revocable living trust allows you, as the grantor, to manage and change the trust terms during your lifetime. You can add or remove assets, change beneficiaries, and even dissolve the trust entirely if your circumstances change. Ordinarily, this type of trust avoids probate altogether, saving your loved ones time and expense.

How Does a Revocable Living Trust Work?

Steve: Let’s say you create a revocable living trust and transfer ownership of your assets into it. You then name yourself as the trustee, meaning you maintain control over the assets. Upon your passing, the trust automatically becomes irrevocable, and the assets are distributed according to your instructions.

This process bypasses probate court entirely. Consequently, your beneficiaries receive their inheritance more quickly and privately.

One of the advantages of a revocable living trust is that it provides privacy. Probate records are public, while trust documents remain confidential.

Have There Been Challenges with Revocable Living Trusts?

Steve: While generally very effective, there have been instances where clients initially forgot to properly fund their trusts by transferring ownership of assets into the trust. Without proper funding, the trust wouldn’t function as intended and might require probate proceedings.

I remember one case where a client had diligently set up a revocable living trust but neglected to transfer his home into it. Unfortunately, this oversight led to some complications during the probate process. We were able to resolve the situation, but it highlighted the importance of meticulous attention to detail when establishing a trust.
