Ted Cook: That’s a great question! I always tell clients to start with a thorough assessment of their assets and liabilities. It’s like building a house – you need a solid foundation before you can start constructing the walls. We create a comprehensive inventory so we have a clear picture of everything involved. Once we have that established, we move onto understanding their goals and priorities. Understanding those goals is crucial to crafting a plan that truly reflects their wishes. We also delve into family dynamics, which can be surprisingly complex. Are there blended families? Once that information is gathered, we move on to choosing key people – the executor, guardian, durable power of attorney, and healthcare agent. Finally, we create the core estate planning documents – the will, trust (if applicable), power of attorney, and healthcare directive. These documents are the legal framework of the plan, and it’s essential that they’re drafted carefully and accurately.

Ted Cook: Absolutely. Step H is often overlooked, but it’s arguably one of the most important. Having a beautifully crafted estate plan is useless if your loved ones can’t find the documents when they need them! The first thing I recommend is a secure, yet accessible, location. A fireproof safe is a good option, but it’s not the only one. Many clients prefer to store their documents with their attorney, as we have robust security measures in place. The key is to choose a location that’s protected from fire, water damage, and theft, but also easy for your designated representatives to access when the time comes.

We also advise creating multiple copies of important documents. One set should be kept in the secure location, another should be given to your executor or trustee, and a third should be kept with your attorney. Digital copies are also a good idea, but they should be stored securely and backed up regularly. It’s not enough to simply store the documents; you also need to inform your loved ones about their location. We recommend creating a letter of instruction, detailing where to find the documents and who to contact in case of an emergency. This letter should be kept with the documents themselves. And finally, it’s important to review and update your documents regularly. Life changes – marriages, divorces, births, deaths – can all affect your estate plan. We recommend reviewing your documents at least every three to five years, or whenever there’s a significant life event. It’s like maintaining a car; you need to perform regular maintenance to keep it running smoothly.

About Estate Planning Law – Ted Cook

Ted enjoys working with clients to create a custom estate plan to protect their assets and to make sure their wishes are reflected in their estate plan. He treats each client as an individual and takes pride in the level of service he provides.

Ted graduated from the U.S. Air Force Academy and was commissioned an Ensign in the U.S. Navy. In the Navy, he was a Surface Warfare Officer and served on three ships on the West Coast. While in the Navy, Ted attended the University of San Diego School of Law where he received his Juris Doctrate degree in 1989. After law school, Ted continued his active duty service in the Navy as a Judge Advocate General Corps officer. After retiring from the Navy in 2011, Ted became a partner with Tom Henry in the law firm of Henry & Cook, LLP focusing on estate planning. Upon the passing of Tom Henry in 2022, Ted started his own firm and continues to help his clients create estate plans that are individually tailored to meet their needs.
