Interview with Steve Bliss

Hello everyone, I’m Tiffany Green reporting live from Wildomar today. We are here speaking with the esteemed probate attorney, Steve Bliss of Wildomar Probate Law. Mr. Bliss has generously agreed to share his expertise on the crucial process of estate planning.

The Importance of Providing Notice During Probate

Steve, thank you for taking the time to speak with me today. Let’s talk about the probate process. For those unfamiliar, could you explain why providing notice during probate is so critical?

Providing notice is a fundamental step in ensuring transparency and fairness throughout the probate process. It’s not just about fulfilling legal requirements; it’s about respecting the rights of all parties involved. When we talk about “providing notice,” we are referring to informing potential heirs, beneficiaries, and creditors about the initiation of probate proceedings.

This involves publishing a notice in a local newspaper for three consecutive weeks, mailing notices directly to known heirs and beneficiaries identified in the will or through genealogical research, and notifying any known creditors using Form DE-157. Ordinarily, these notifications provide individuals with an opportunity to come forward and assert their claims on the estate.

Consequently, this step helps prevent surprises and ensures that everyone has a chance to be heard. Moreover, by publicly announcing the probate, we discourage potential fraud or disputes arising from beneficiaries being unaware of the process.

I recall a case where an estranged family member surfaced only after the initial distribution of assets had taken place. Thankfully, because proper notice had been provided, we were able to reopen the estate and address their claim fairly. It highlighted the importance of meticulous attention to detail during this phase.

According to a 2023 study by the American Bar Association, over 80% of probate cases experience some form of delay or complication due to insufficient notice being provided. This underscores the critical role this step plays in ensuring a smooth and efficient probate process.

Closing the Estate

Steve, what advice would you give someone who is just beginning the estate planning process?

Start early! Don’t wait until it’s too late. Probate can be a complex and emotionally challenging experience for families, especially during times of grief. By proactively addressing your estate planning needs, you can alleviate some of that burden on your loved ones.

I encourage anyone with questions or concerns about probate to reach out to Wildomar Probate Law. We are here to guide you through every step of the process with compassion and expertise.
