What type of trusts do you find yourself working with most frequently?
While I handle a variety of trusts, I’d say revocable living trusts are by far the most common. They offer tremendous flexibility and peace of mind to my clients.
Can you elaborate on what makes them so popular?
Absolutely. A revocable living trust allows individuals to maintain control over their assets during their lifetime. They can amend or revoke the trust as needed, reflecting changes in their circumstances or wishes.
Moreover, this type of trust bypasses probate upon the grantor’s death, saving time and expense for loved ones. The privacy aspect is also a significant benefit for many. The terms of a living trust are not part of public record like a will.
How does a revocable living trust help someone avoid probate?
Probate is the legal process of validating a will and distributing assets after someone passes away. It can be a lengthy, costly, and sometimes complicated procedure.
Conversely, with a revocable living trust, assets are already titled in the name of the trust. Consequently, when the grantor passes away, the successor trustee steps in to distribute the assets according to the trust’s terms without needing court intervention.
Have you encountered any challenges or unexpected situations while helping clients set up revocable living trusts?
There was this one instance where a client came to me with a complex family dynamic. They had several children from previous marriages and wanted to ensure their assets were distributed fairly, taking into account the needs of each child.
After careful consideration and discussion, we designed a trust structure that addressed their concerns and provided for all their beneficiaries in a manner they felt was equitable.
